EU Plastics Recycling Rules 2026: What Is Now Law and What Funding Is Available

In December 2025 the European Commission published a pilot package of measures to support the plastics recycling sector. Half a year later, two of those measures are no longer proposals. The EU wide end-of-waste criteria for plastics apply from 1 July 2026, and the new rules for recycled content in PET bottles were adopted on 30 June 2026. This article explains what is now law, what is still coming, and which EU funding programmes are open.

Status in August 2026: a short summary

On 23 December 2025 the European Commission presented a package of pilot measures for the plastics sector, together with a communication on accelerating the transition to a circular economy. The package was a first step. A broader Circular Economy Act was announced for 2026.

Since then, the situation has changed in a way that matters directly for daily operations. Two measures have completed their legal procedure, and companies now have fixed dates to work with rather than draft texts to comment on.

Why the Commission acted

The European plastics recycling sector has been under heavy pressure. Of roughly 58 million tonnes of plastic produced in the EU, the Commission states that about half is collected and sorted, and around 13% is recycled into new plastics. Installed plastics recycling capacity in the EU reached about 13,2 million tonnes in 2023, but the growth rate had already turned negative, and the Commission expected a net loss of roughly one million tonnes of capacity by the end of 2025.

The wider circularity picture is similar. Recycled materials accounted for 12,2% of material use in the EU in 2024, compared with 11,2% in 2015. Between 2010 and 2024 the share rose by only about 1,5 percentage points. The EU target is a circularity rate of around 24% by 2030, so the gap is large.

The Commission identifies four main pressures on the sector:

  • Fragmented markets for recycled materials between Member States.
  • High energy costs in Europe compared with other regions.
  • Volatile virgin plastic prices.
  • Competition from third country imports.

There has been one temporary counter movement worth noting. According to Recycling Europe, the sharp rise in oil prices during the first quarter of 2026 made virgin plastics more expensive and gave European recyclers short term relief. That relief depends on oil markets, not on structural change, which is exactly what the regulatory package is intended to address.

The five measures and where each one stands

1. EU wide end-of-waste criteria for plastics Finalised

This is the most important measure for European recyclers. Until now, each Member State decided on its own when recycled plastic stopped being waste and could be used again as raw material. This created barriers inside the Single Market and added administrative work, especially for small and medium sized recyclers.

The implementing act under the Waste Framework Directive was published as a draft on 23 December 2025, with public feedback open until 26 January 2026. The harmonised criteria have since been established and are due to apply from 1 July 2026. Under these criteria, recycled plastic that meets the requirements is no longer waste but a product, described in the text as plastic recyclate.

The scope is important to understand correctly:

  • The criteria cover mechanical and physical (solvent based) recycling, where the polymer chains are retained. Chemical recycling is not included at this stage.
  • They apply to thermoplastic polymers and blends of thermoplastic polymers, regardless of polymer type.
  • End-of-waste status applies to material destined for the production of new plastic products, not for energy recovery or fuel production.
  • The requirements are grouped into input material, treatment processes, and output product quality, with a quality management system behind them.
  • Additional decontamination steps are required where the recyclate is used for food contact materials.

What this means in practice

From 1 July 2026, a recycler producing recyclate in one Member State can sell it to a processor in another Member State without going through separate national approval procedures. This should reduce paperwork, particularly for SMEs, and support a real Single Market for recycled plastics.

The other side of the coin is documentation. End-of-waste status is not automatic. It has to be demonstrated through a quality management system covering input, process and output, verified by an accredited conformity assessment body or an environmental verifier. outside the EU suppliers of recycled plastic packaging to the EU food and beverage sector face equivalent requirements.

2. Recycled content rules for PET beverage bottles Adopted

Under the Single-Use Plastics Directive (Directive (EU) 2019/904), PET beverage bottles must contain a minimum of 25% recycled content from 2025, rising to 30% in all beverage bottles by 2030. What was missing was a clear method for calculating and verifying that content, in particular for chemically recycled material.

That method is now settled. Member State representatives voted in favour of the draft at the Waste Technical Adaptation Committee on 6 February 2026, and the Commission adopted Commission Implementing Decision (EU) 2026/1425 of 30 June 2026, which repeals the earlier Implementing Decision (EU) 2023/2683. The decision enters into force twenty days after publication in the Official Journal.

The main points for producers and converters:

  • Chemically recycled content can count towards the targets, alongside mechanically recycled content, using mass balance rules including a fuel exempt approach.
  • Recycled plastic must originate from post consumer plastic waste recycled in an environmentally sound manner.
  • For the purpose of the calculation, a PET bottle includes the body, cap, lid and the label or sleeve.
  • Recycled PET produced outside the EU cannot count towards the 25% target for PET beverage bottles until 21 November 2027, when imports from OECD countries become permitted.
  • The Commission will review the decision by 1 January 2030 at the latest.

For chemical recyclers, this is the legal certainty that had been missing. For bottle producers and brand owners, it fixes the method they must use for reporting.

3. Relaunch of the Circular Plastics Alliance In progress

The Circular Plastics Alliance was launched in December 2018 under the European Strategy for Plastics. Its original goal was to put 10 million tonnes of recycled plastics into new products by 2025. That target was not reached.

The Alliance is being relaunched during 2026 with a new structure and a joint work plan, bringing together industry, Member States and the Commission. The stated focus areas are market surveillance priorities, stimulation of market demand, and the development of customs codes for recycled plastics.

4. Fair competition with imports In progress

The Commission is creating separate customs codes for virgin and recycled plastics. Today the two often share the same code, which makes enforcement difficult. Separate codes are also planned for recycled polymers relevant to other sectors.

An Import Surveillance Task Force has been set up, and the Commission monitors EU and global markets for virgin and recycled plastics to inform possible trade measures. Six trade defence measures already apply to plastic related products, including anti-dumping duties on PET from China and anti-subsidy duties on PET from India, covering both recycled and virgin PET.

Export ban: a date to plan for

Under Regulation (EU) 2024/1157 on shipments of waste, exports of plastic waste from the EU to outside the OECD countries are prohibited from 21 November 2026 until 21 May 2029, with the possibility for outside the OECD countries to apply for an exemption. More plastic waste will therefore have to be treated inside Europe, which increases both the pressure on and the opportunity for European recycling capacity.

5. Support for investment and innovation Scoping

The Commission plans to step up support for circular projects together with national promotional banks and the European Investment Bank. A pilot under the Competitiveness Coordination Tool will support so called Trans-Regional Circularity Hubs, which are intended to encourage cross border cooperation and economies of scale between manufacturers, recyclers and waste operators.

It is worth being realistic about the current stage. According to the Commission’s own page on the subject, the scoping of concrete measures with Member States and industry is still under way, working towards a political document with delivery targets for agreed investments. There is no open application procedure for the hubs at this point. The programmes listed further below are the ones that companies can actually apply to today.

Separately, the Commission adopted a proposal on accelerating and streamlining environmental assessments, intended to shorten permitting procedures for recycling and circular projects.

EU funding open to plastics and recycling companies

The package refers to investment support in general terms. In parallel, several concrete grant programmes are open or opening. The table below lists the main ones relevant to plastics recycling, testing and material development. Conditions change, so always check the current call text on the EU Funding and Tenders Portal before preparing an application.

One practical point. Most of these calls require a consortium from several countries rather than a single company applying alone. They suit joint projects with customers, suppliers, universities or research institutes better than a standalone equipment purchase. For a single company, national and regional circular economy or green investment schemes are often the more realistic route, and these vary from one Member State to another.

What industry associations say

The reactions to the package have been mixed, and the disagreement is useful to understand because it points to what is still open in the Circular Economy Act.

Plastics Europe, the pan European association of plastics manufacturers, welcomed the package as a first step. Managing Director Virginia Janssens described harmonised end-of-waste criteria as a welcome move to cut red tape and support a functioning single market. She also argued that limiting the criteria to mechanical recycling alone could hold back Europe’s circularity ambitions, and called for them to be extended to all recycling technologies.

The European Waste Management Association (FEAD) was more critical. Secretary General Paolo Campanella said the absence of a clear “Made in Europe” requirement for recycled content is a missed opportunity, and called the signal sent to the market clearly insufficient at a time when European recyclers are under severe pressure. FEAD, together with Plastics Recyclers Europe and Recycling Europe, had asked the Commission to ensure that recycled plastic used to meet EU targets comes from post consumer waste collected and recycled in Europe.

Recycling Europe made a related argument in its consultation response: with the export restrictions arriving in November 2026, far more plastic waste will need to be recycled inside the EU, which makes a properly functioning internal market for recycled plastics more urgent.

From the Commission side, Jessika Roswall, Commissioner for Environment, Water Resilience and a Competitive Circular Economy, has said the measures aim to create new opportunities for European industry, speed up the transition to circularity and reduce dependency on imports. She has also stated that the Circular Economy Act must balance harmonised rules, enforcement and market surveillance, and economic incentives.

In summary, the direction is broadly accepted. The dispute is about demand side measures and whether European recyclate will be given priority. This will be one of the main discussion points in the Circular Economy Act.

Practical consequences for processors and recyclers

For companies working with plastics, the following points are the ones that translate into work on the shop floor and in the office.

  • Check your end-of-waste documentation. If you produce or buy recyclate, the quality management system covering input material, recycling operation and output quality is now the basis for treating that material as a product. Verification by an accredited conformity assessment body or environmental verifier is part of the requirement.
  • Confirm the status of your material streams. The criteria cover mechanical and physical recycling of thermoplastics. Material from chemical recycling is treated differently, and is currently outside the end-of-waste rules even though it can count towards PET recycled content targets.
  • Review your recyclate sourcing. With separate customs codes coming and with imported rPET excluded from the PET bottle target until November 2027, the origin of your recyclate now has a direct compliance consequence, not only a commercial one.
  • Prepare for higher and more consistent quality requirements. As recycled content targets become enforceable, brand owners and converters will scrutinise consistency, contamination and processability far more closely.
  • Plan for more material entering the European market. The export ban from November 2026 will keep more plastic waste inside Europe. This changes both feedstock availability and the competitive situation.
  • Check the PPWR timeline in parallel. Most provisions of the Packaging and Packaging Waste Regulation apply from 12 August 2026, with recyclability performance grades from 2030. The plastics package and the PPWR reinforce each other.

Why laboratory testing becomes more important

Every one of the points above leads back to the same practical question: will the material actually run on your line, and will the finished product meet specification?

Recycled grades behave differently from virgin material. Melt flow varies between batches. Contamination, moisture and residual additives affect stability. Blends of recyclate and virgin resin, or recyclate and bio based material, often need different temperature profiles, screw speeds and die settings. Finding this out during a production run is expensive.

A laboratory extruder is the practical way to answer these questions before full scale production. With a small line, a company can:

  • Test new recycled grades without occupying production capacity.
  • Establish process settings for stiffer, more sensitive or more variable resins.
  • Compare batches from different suppliers on a like for like basis.
  • Document processability as part of quality control for incoming recyclate.
  • Train operators on new materials safely.
  • Reduce scrap, downtime and risk on the production line.
